Buying jewellery online

In response to questions from some of our clients about the Islamic ruling on buying jewellery online and paying through Tabby and Tamara, we share below a number of fatwas issued by distinguished scholars in the Kingdom of Saudi Arabia.

These materials are shared for reference and benefit. GHALIA is not a body authorised to issue or interpret Islamic legal rulings, as the ruling may differ depending on the details and circumstances of the transaction.

Buying jewellery through online stores

A fatwa by His Eminence Sheikh Prof. Saad bin Turki Al-Khathlan on buying gold and silver electronically, and how lawful possession (taqabud) is achieved when the shipping company takes delivery of the piece on the customer’s behalf.

Paying in instalments through Tabby and Tamara

A fatwa by His Excellency Sheikh Prof. Abdullah bin Mohammed Al-Mutlaq, member of the Council of Senior Scholars, on the ruling of purchasing with instalment services such as Tabby and Tamara.

How taqabud is achieved in our store

Selling gold requires possession in the session. This is how that condition is met when you buy from GHALIA online.

  1. When you complete payment

The amount sits with us as a trust (amanah). It is not yet received as the price, and the sale is not concluded at this moment.

  2. When the piece is handed to the shipping company

The shipping company takes possession on your behalf as your agent for receipt. Your possession of the piece is achieved at this moment.

  3. The sale is concluded

At the same moment, the amount converts from a trust into a received price. Both sides take possession at once, and the sale is valid, by the will of Allah.
